Contractor Claims and Delay Risk Analyser

For employers, PMOs, engineers and contractors on large works contracts. Choose your contract form and list the delay events. The analyser shows the usual risk allocation for each cause under FIDIC 2017, FIDIC 1999 and NEC4, the delay days that may justify an extension of time, events that usually carry cost, Contractor-risk delay that exposes delay damages, and the weaknesses that lose claims: late notices, thin records, no critical path analysis and concurrency.

Who it is for

  • Employer's representatives, PMOs and project managers
  • FIDIC Engineers and NEC Project Managers
  • Contractors' commercial and planning teams
  • PIU contract managers on donor-financed works
  • Lenders' technical advisers

What you get

  • Typical entitlement for each event (time and cost, time only, conditional, Contractor risk)
  • Exposure in days, and delay damages if you enter the daily rate
  • A strength rating for each event
  • Notice rules for your contract form
  • A prioritised action list

How this tool works

Built on
Risk allocation in FIDIC 2017 (Red, Yellow, Silver), FIDIC 1999 and NEC4 ECC for common delay causes; notice rules of each form; delay analysis principles of the SCL Delay and Disruption Protocol.
Scoring
Each event scores out of 100: notice in time 35, full records 35 (partial 15), on the critical path 20 (near critical 10, not analysed 5), no concurrency 10. The overall score combines the events (60%) with the project controls in step 3 (40%).
Limitations
Delay days are not additive when events overlap; only a delay analysis on the accepted programme gives the real extension of time.

Questions

Which contract forms does it cover?

FIDIC 2017 Red, Yellow and Silver Books, the FIDIC 1999 suite and NEC4 ECC. For bespoke contracts it shows the usual position as a starting point.

Can it calculate the extension of time?

No. It shows the order of magnitude. The real extension depends on a delay analysis (for example time impact analysis) on the accepted programme.

Is it for employers or contractors?

Both. For the employer it shows exposure; for the contractor it shows the strength of each claim and what to fix.
